Second, there are the personal qualities, background, and circumstances of your life that can help you. You are a human being first, who is charged with a crime. Unfortunately, all too often District Attorneys see you as a criminal first, and a human being, second, but sometimes not at all.

The Southwest Justice Center, The Banning Justice Center, and The Larson Justice Center in Indio are frequent courts that people get charged with illegal narcotics possession, sales, or with intent to distribute in Riverside County, California.
Legal questions I will ask you if you are charged with possession of drugs, narcotics, manufacturing, or possession with the intent to sell or distribute:
- Have you given any statements to law enforcement? Keep in mind, pursuant to the 5th Amendment to the United States Constitution, you have a right to remain silent. You don’t have to talk to law enforcement. As a former prosecuting attorney, confessions are the greatest gifts that defendants ever gave me. Especially if the confession was conducted properly and in accordance with the constitution. So if you have given any statements, I will need to look closely at the facts and circumstances surrounding that statement.
- Was there a search warrant? Search warrants are legal documents signed by judges that give the police the right to search your home or private home for specific items that are listed in the search warrant. There is a procedure that the police have to go through in order to get a search warrant.
- Was there consent given to search? Often times, police will ask for consent to search. In this case, again, the facts and circumstances surrounding that consent will have to be closely examined.
- What was found, how was it found, where was it found? All these facts need to be fully and completely understood before any legal defenses can be established or before any constitutional issues can be raised.
- More questions will arise from the first 4 questions. If you have been charged with illegal drug or controlled substances in Palm Springs, Indio, Banning, Murrieta, Temecula — or even Anza or Idyllwild, please get a criminal lawyer/attorney with the experience to really probe deeply into the state’s case. Criminal charges are brought against people all the time that do not have enough evidence to convict, or are riddled with constitutional violations.
Personal questions I will ask you as a criminal defense attorney if you are charged with drug possession, possession of narcotics with intent to distribute, manufacturing of controlled substances:
- What is your immediate background that lead up to being charged with this illegal narcotics charge?
- What are your relationships with other people who are involved?
- What human struggles have you survived that can shed light on being charged with illegal drug possession?
- What was your deep background? Are there any long-standing personal or childhood issues or problems that may have contributed to being charged?
- Do have a support network of family and friends who can help you get through being charged with a drug crime?
- Are you employed?
- Are you clean and sober now? Many of my criminal clients get clean and sober long before the state gets around to bringing charges. Being clean and sober is one of the most important personal issues that can have an impact on your charge. You will see no cloth around my neck, as I am a criminal attorney not a priest. So no moral judgments will come your way from me. My only goal will be to point you in the right direction should you need help. Narcotics Anonymous is a great place to start.It’s never too late to get clean and sober.
